Je nám ctí oznámit, že Advokátní kancelář Havlíček uspěla v mezinárodním sporu mezi investorem z USA a českým subjektem o náhradu škody ve výši cca 30 mil USD, tedy cca 750 milionů Kč.
Spor byl řešen od roku 2019 do roku 2022 u ICC International Court of Arbitration podle jeho pravidel. ICC International Court of Arbitration je od roku 1923 nejrenomovanější institucí pro řešení mezinárodních obchodních sporů a je zřízen při Mezinárodní obchodní komoře v Paříži.
Místem konání řízení byla Vídeň (Rakousko). Počátek sporu se datoval do roku 2003 a Advokátní kancelář Havlíček musela rekonstruovat celý příběh od samého počátku, aby tribunál disponoval kompletním povědomím o případu. Pravdivý obraz případu a brilantní argumentace expertů na hmotné právo přinesli úspěch. Celý nárok na náhradu škody uplatněný americkým investorem byl tribunálem s konečnou platností zamítnut a náš klient nemusí hradit téměř ¾ miliardy Kč.

Havlíček Law Offices succeeded in an ICC international arbitration
We are honoured to announce that Havlíček Law Offices has succeeded in an international dispute between a US investor and a Czech entity for damages amounting to USD 30 million, i.e. approx. CZK 750 million. The arbitration ran from from 2019 to 2022 under the ICC International Court of Arbitration Rules. Established in 1923, the ICC International Court of Arbitration is the most renowned institution for the resolution of international commercial disputes and operates under the auspices of the International Chamber of Commerce in Paris.
The place of the arbitration proceedings was Vienna (Austria). The start of the dispute dates back to 2003 and Havlíček Law Offices had to reconstruct the entire story from the very beginning so that the arbitral tribunal had complete knowledge of the case. In the end, the true picture of the case and the brilliant arguments put forward by the substantive law experts brought success. The US investor’s entire claim for damages US investor was ultimately rejected by the tribunal, meaning that our client does not have to pay almost three quarters of a billion Czech koruna.
