Novináři někdy napíší pravdu o zákoně, kterým byl vyvlastněn majetek Dr. Adolfa Schwarzenberga, zarputilého antifašisty a podporovatele exilové vlády v Londýně, viz např.:

Za svou podporu Čechů a Československa se mu po skončení druhé světové války dostalo nespravedlivého trestu. Když jako Čech a antifašista nemohl být postižen Benešovými dekrety, byl vyvlastněn zákonem, který směřoval jen k vyvlastnění majetku pouze jeho rodiny. Stát se víc než 30 let tváří, jako by se ho to netýkalo a překrucuje pravdu, historii, právo i spravedlnost. 

„Vzniká tu absurdní situace, kdy Ústavní soud opakovaně zamítl naši ústavní stížnost s odkazem na lex Schwarzenberg, ale zároveň se tváří, že lex Schwarzenberg je mrtvý zákon,” kritizuje takový postup Jan Havlíček, advokát zastupující Alžbětu Pezoldovou...

„Z doložených dokumentů vyplývá, že velká část schwarzenberského majetku byla přepsána nejdříve v druhé polovině roku 1948, tudíž by se na něj měly vztahovat restituční nároky, ale soudy tyto dokumenty, domnívám se záměrně, přehlížejí,”…

„Odvolávají se dokola na jediné, a dle mého názoru vadné, rozhodnutí Ústavního soudu z roku 1995 (zn. IV.ÚS 129/94), které tvrdí, že došlo ke ztrátě vlastnického práva k majetku dnem vyhlášení zákona č. 143/1947 Sb. Přitom i v samotném Lex Schwarzenberg je v paragrafu č. 4 nařízena povinnost vkladu vlastnického práva a stejně tak dokument z 3. června 1948 vydaný Prozatímním podnikovým ředitelstvím v Českých Budějovicích jasně hovoří o nutnosti zápisu vlastnického práva k majetku hlubocké větve,”…

„Aby ten majetek nemusel být vrácen, vymysleli onen ex lege efekt s okamžitou platností, který tvrdí, že majetek rodu Schwarzenbergů přechází na Českou zemi ke dni účinnosti zákona č. 143/1947 Sb.”

Není ale spravedlnost jenom jedna? Neměl by stát měřit všem stejným metrem? Stát si má chránit své hrdiny, bojovníky za jeho svébytnost a suverenitu. „Odměna“ vyvlastněním majetku není a nemůže být probována rozhodnutím soudů demokratického právního státu. 

Vědecká konference Dny práva pořádaná Právnickou fakultou Masarykovy univerzity přinesla celou řadu článků na téma restitucí, vystoupili např. JUDr. PhDr. Stanislav Balík, JUDr. Jan Havlíček, Ph.D. a Adam Pezold. Srovnáním těchto tří příspěvků uveřejněných ve sborníku nelze dospět k jinému závěru, než že nejen v období po druhé světové válce, ale i po roce 1990 se Česká republika chovala diskriminačně proti JUDr. Adolfu Schwarzenbergovi a jeho rodině, což potvrdil i Výbor OSN pro lidská práva (více o rozhodnutí Výboru příště). 

NIL NISI RECTUM! NIC NEŽ PRÁVO! Toto heslo stojí na starém rodovém erbu Schwarzenbergů. Nic jiného nechtějí ani nyní. Advokátní kancelář Havlíček od roku 2016 hrdě hájí právo na straně Alžběty von Pezold.

Rescind, or keep denying justice?

Journalists sometimes write the truth about the law that expropriated the property of Dr. Adolf Schwarzenberg, a staunch anti-fascist and supporter of the government-in-exile in London; see for example:

For his support of the Czechs and Czechoslovakia after the end of the Second World War, Dr. Adolf Schwarzenberg received an unjust punishment. As a Czech and an anti-fascist he was outside the scope of the Beneš Decrees, but he was deliberately targeted by a law design to expropriate the property of his family alone. For more than 30 years, the state, while acting as though this has nothing to do with it, has distorted truth, history, law and justice. 

“An absurd situation has arisen here, where the Constitutional Court has repeatedly rejected our constitutional complaint by referring to LexSchwarzenberg, while at the same time pretending that Lex Schwarzenberg is a dead law,” says Jan Havlíček, the attorney representing Alžběta Pezoldová, in his criticism of this procedure…

“The documentary evidence shows that a large part of the Schwarzenberg property was transferred in the second half of 1948 at the earliest, so it should be subject to restitution claims, but the courts – deliberately, I believe – overlook these documents,”…

“They refer over and over again to a single, and in my opinion flawed, decision of the Constitutional Court from 1995 (No. IV.ÚS 129/94), which asserts that the loss of title to the property occurred on the date of the promulgation of Act No. 143/1947 Coll. However, Article 4 of Lex Schwarzenberg itself imposes an obligation to register the title; equally, a document of 3 June 1948 issued by the Provisional Works Directorate in České Budějovice clearly speaks of the necessity to register the title to the property of the Hluboká branch,”…

“To ensure that the property did not have to be returned, they invented this ex lege effect with immediate validity, claiming that the property of the Schwarzenberg family passed to the Czech Republic on the date of the entry into force of Act No. 143/1947 Coll.”

But isn’t there only one justice? Shouldn’t the state measure everyone by the same yardstick? The state should protect its heroes, those who fought for its independence and sovereignty. The “reward” of expropriation is not and cannot be approved by the decision of the courts of a democratic state governed by the rule of law. 

The Law Days research conference organized by the Faculty of Law of Masaryk University gave rise to a number of articles on the topic of restitution: speakers included JUDr. PhDr. Stanislav Balík, JUDr. Jan Havlíček, Ph.D. and Adam Pezold. Comparing these three papers published in the proceedings, one can only conclude that not only in the post-World War II period but after 1990 as well, the Czech Republic behaved in a discriminatory manner towards JUDr. Adolf Schwarzenberg and his family, as confirmed by the UN Human Rights Committee (more on the Committee’s decision next time).
